rticle 22(1) of the Indian Constitution provides fundamental legal safeguards to every person who is arrested. When the police arrest an individual, they must inform that person, as soon as possible, of the grounds for the arrest. Knowing the reasons for one’s arrest is a fundamental constitutional right and an essential safeguard against arbitrary detention.
Furthermore, every arrested person has the right to consult and be defended by a legal practitioner of their choice. This means that an individual can select a lawyer, seek legal advice and receive professional legal assistance to defend themselves. Denying a person access to legal counsel would undermine the protection guaranteed under this constitutional provision.
This Article establishes a legal balance between the powers of the police and the personal liberty of citizens. Being accused of an offence does not mean that an individual loses their fundamental rights. Article 22(1) reinforces the democratic principle that every individual is entitled to legal protection and fair treatment under the law.
In addition, Article 22(2) of the Constitution provides that an arrested person must be produced before the nearest magistrate within 24 hours of arrest, excluding the time necessary for the journey from the place of arrest to the magistrate’s court. No person can be detained beyond this period without the authority of a magistrate. However, the constitutional exceptions specified under Article 22(3), including certain preventive detention provisions, must also be taken into account.
The powers of the police are subject to the law and cannot be exercised according to personal discretion. Every arrested individual is entitled to the protections guaranteed by the Constitution and the established legal process. Article 22(1) is therefore not merely a legal provision; it is a vital constitutional safeguard that protects individual liberty, dignity and the right to legal representation in a democratic society.
